Many of the modern neighborhoods in our area are planned developments that are governed by some form of mandatory membership association, commonly called a “Homeowners Association” (HOA). Homeowners in this sort of association usually own their land and the house itself, including the walls, floors, ceilings, etc.

For the most part, the Board of Directors for these associations have a primary responsibility to maintain and repair certain common elements of their community in a timely manner. These elements may include tennis courts, basketball courts, swimming pool areas, gatehouses, roads and open space area used for the enjoyment of the residents. Landscaping and maintenance of the dwelling itself, on the other hand, is left up to the homeowner. And while the homeowner may be responsible for such things as painting, roof and structure maintenance, the homeowners associations may impose restrictions on this as well, including the color of the paint or the type of materials used for roofing or landscaping.

In many cases, your homeowners association will voluntarily assume the responsibility of certain maintenance items in order to retain the uniform appearance of the community. Trees, sidewalks and mailbox maintenance are some examples of this, in which the association would budget accordingly to provide for the repairs and replacement of these items.

State statutes for homeowners associations are typically considered less stringent than condominiums, but over the past years, the gap between the two has been lessened considerably.

Clerical and accounting responsibilities include maintaining accurate records, financial reporting, billing, and collections of assessments and payments of invoices for work performed to maintain the community.
